Terms of Service

1. Agreement

By registering for or using ShiftDesk (“the Service”), you agree to these Terms of Service on behalf of yourself and, where applicable, the business you represent (“the Customer”). These terms form a binding agreement between you and ShiftDesk Ltd.

If you do not agree to these terms, do not use the Service.

2. The Service

ShiftDesk provides a cloud-based workforce management platform including shift scheduling, leave management, and employee administration tools for UK small businesses. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and access

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account or allow unauthorised access.
  • You are responsible for all activity under your account.
  • Accounts are for business use only. You must be at least 18 years old to register.

4. Subscription and billing

  • Subscriptions are billed monthly in advance. Prices are listed on our pricing page.
  • Payments are processed by Stripe. By subscribing, you authorise recurring charges.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no refunds are issued for partial periods.
  • We reserve the right to change pricing with 30 days' written notice.
  • All prices are in GBP and exclusive of VAT unless stated otherwise.

5. Customer data and GDPR

You retain ownership of all employee and business data you upload to ShiftDesk. By using the Service, you appoint ShiftDesk Ltd as a data processor under UK GDPR Article 28. Our Privacy Policy forms part of this agreement and constitutes our data processing terms.

You are responsible as the data controller for ensuring you have a lawful basis to process your employees' personal data within ShiftDesk, and for complying with your obligations under UK GDPR and the Data Protection Act 2018.

6. Working Time Regulations compliance

ShiftDesk generates shift schedules and working hours records. However, the platform does not automatically enforce UK Working Time Regulations compliance (48-hour average working week, rest breaks, etc.). You (as the employer/data controller) remain solely responsible for ensuring your use of ShiftDesk complies with the Working Time Regulations 1998, the Health and Safety at Work Act 1974, and all applicable UK employment law. ShiftDesk should not be the sole system for managing WTR compliance.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service or other customers' data
  • Upload malicious code, viruses, or disruptive content
  • Reverse-engineer, decompile, or create derivative works from the Service
  • Resell or sublicense access to the Service without our written consent

8. Limitation of liability

To the maximum extent permitted by law, ShiftDesk's total liability for any claim arising from these terms or your use of the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

We are not liable for indirect, consequential, or incidental losses including lost profits, data loss, or business interruption, even if advised of the possibility.

9. Termination

We may suspend or terminate your account immediately if you materially breach these terms. Upon termination, your data will be retained for 30 days during which you may request an export, after which it will be deleted in accordance with our data retention policy.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
